Planning and Zoning


The Planning and Zoning Division is responsible to staff support for long and short range planning; to provide information on lamd development standards and procedures; prepare technical reports and an analysis for zoning and zoning related matter; land use and land use amendments; site plan review and zoning compliance; implementing and updating the Comprehensive Plan and Land Development Regulations; Building permitting; Land clearing and tree removal permitting and Business License Tax Receipts.

Yes.

What are Land Development Regulations?

Land Development regulations including regulations that pertain to matters such as zoning, development standards, building height, subdivisions, wetlands, land clearing, tree removal signas, sea turtle lighting, and concurrency management.

 

Are copies of the Future Land Use Available?

The FLUM may be purchased through the City Clerk's Office.

Are copies of the Flood Insurance Rate Map Available?

How can I use my property?

This type of use(s) a property owner is permitted depends on the current zoning district classification indicated on the zoning map, and the land use classification indicated on the zoning map, and the land use classification prescribed on the Future Land Use Map.  Certain districts permit different types of  land development and land use activities on a given parcel of land.  Please contact the Planning and Zoning Department to determine the principal permitted uses, accessory uses and Special Exception uses allowed on your property parcel number.

 

Can I obtain a written confirmation of zoning, future land use designation or confirmation of reconfiguration lots of record?

A written confirmation can be provided upon written request.  A complete legal description of the property in question must be provided.  The established fee for this service is $55.00.

 

How can I change the zoning on my property?

A property owner may request a zoning classification change.  The process involves filing of appropriate application documents, staff review, public notice, a minimum of two public hearings (Planning and Architectural Review Board and approval by the City Commission) and payment of  related fees.  Fee charges may be obtained at the Planning and Zoning Department.

 

What is the maximum building height?

The maximum building heights is thirty five (35) feet.  The building height measurement is dependent up on the type of roof (flat, mansard, gable, etc.) design for the

structure (s).

 

Can I build a boathouse, dock, private garage or other such structure on my property prior to constructing a home?

The structures would be consider accessory structures and may not be constructed until a building permit has been obtained for the primary structure.

 

Setbacks

Established in the Land Development Regulations, it is a line generally parallel to and measured from the property line which defines the yard area in which no building, other than accessory structures may be located above grade, except as otherwise provided in the Land Development Regulations.

 

Setbacks are measured from the property line to the wall or supporting portion of a structure.  For those lots that front on the Atlantic Ocean, the established Coastal Construction Line (CCL) is the setback line, unless a permit has been obtained from the Department of Environmental Protection approving construction seaward of the CCL.

 

Accessory structures are required to meet minimum setbacks based on the zoning classification.  No accessory structure is permitted in a required front yard area.  Specific setback requirements for accessory uses can be obtained a the Planning and Zoning Department.

 

Fences

For residential zoned property, no fence, wall or hedge shall exceed four (4) feet in height in the required front yard area.  No fence or wall shall exceed six (6) feet in the side yard or rear yard area.  If you have any questions, please contact us


 

Building and Permitting

 

The City of Flagler Beach is engaged in an inter-local agreement with Flagler County and the Flagler County Building Department to provide building official and building official related services.  The City of Flagler Beach serves only as a processing center for most permits.  Building permit applications are submitted and obtained at the City of Flagler Beach as well as payment of all fees and charges.  For information regarding current impact fees, click here.  The City of Flagler Beach reviews permits for zoning  and flood prevention compliance.  Building plan review, field inspections, re-inspections and the like, are provided by the Flagler County Building Department.  Specific questions pertaining to building codes and standards information and practices should be redirected to:  Gary Hiatt, Chief Building  Official of Flagler County e-mail:  ghiatt@fcbcc.org

Florida Statewide Building Code

The State of Florida has adopted a new statewide building code, which became effective on October 1, 2005, Information on the Statewide Building may be found at the Florida Building Commission website:  www.floridabuilding.org.

Inspections

Inspections are conducted at various stages of construction and prior to finalization of  permits on residential and non-residential structures for building, electrical, mechanical and gas permits.  Other inspections are conducted based on the nature of the building permit issued.  All permits require a final inspection, failure to final out permits may result in revocation of permitting privileges, additional fees and/or code enforcement action.

How long does a permit stay active?

The Statewide Buildng code allows for periods of up to six months to lapswithout requiring work to proceed on an individual job site.

 

Can a building permit be extended?

One or more extensions of tme for periods of not more than ninety (90) days each may be allowed by the building official for the permit, provided the extension is requested in writing and justifiable cause is demonstrated.

 

As a contractor, what licenses are required to apply for a permit?

You will need to have the appropriate qualifications by Flagler County Building Services.  For further information, please call (386) 313-4002.

 

When is a Notice of Commencement required?

This docuemnt is requied whent he vlaue of work exceeds $2500, or in the case of mechanical work, $7500. The Notice of Commencement must be certified and recorded by the Recording Department in the Flagler County Courthouse at 200 East Moody Boulevard, Bunnell, FL. 

 

When is Mecanics Lien Affidavit required?

This document is required, signed by the owner and notarized, when using a contractor and the value of the labor and material is over $2500 in value.  A stamped envelope addressed to the owner is also required.

 

When is an Owner Building Disclosure Statement required?

This document is required when an owner is acting as his/her own contractor.  You must supervise the work being performed.  Any unlicensed workers must be employed by you, which means you much deduct FICA and withholding tax and provide workers compensation.

 

How is an inspection requested?

Inspection requests are made by calling A.I.R.S. (Automated Inspection Request System) at (386) 313-4090.  You will need your permit number, confirmation number and inspection code.  All these numbers can be found on  y0ur permit and inspection card.

 

Do the approved building plans have to be on the job site for inspections?

Yes, posted along with your permit, inspection card and Notice of Commencement.

 

Who is permitted to call for an inspection?

Whoever is listed as the contractor of record.

 

When I can for inspection, when will it be done?

License business Tax Receipt

 

  • A Local Business Tax Receipt is required for all entities conducting business with a City of Flagler Beach address.

 

  • An annual fee of $50.00 must be paid.  Each license is issued for one year commencing October 1 and valid through September 30th of the following year.

 

  • Each NEW applicant applying  for a Business Tax Receipt must pay a one-time fee of $45.00.

 

  • A business registration is required for anyone conducting business activity within the City of Flagler Beach, with a business address being other than Flagler Beach.  The yearly fee is $25.00 and is valid from October 1 through September 30.  Documents will be kept on file for permitting purposes.

 

  • Transfer of a Local Business Tax receipt requires the issue of a new license.  The fee is $8.00.

Yes, anyone conducting business within the  County is required to have a local business tax receipt of the county where the business is located.

How long does it take for a new Local Business Tax Receipt to be issued?

Providing you have all required documents, our office conducts a zoning review, and your license can be issued in a day or two.
